OTHER STAFF MEMBERS PRESENT Jim Narey, Planning Director OTHER STAFF MEMBERS ABSENT Mizan Rahman, City Engineer Chairman Todd called the regular meeting of the Maumelle Planning Commission to order at 6:30 pm. ANNOUNCEMENTS Mr. Narey reminded the Commission their financial reports were due to the City Clerk by Monday, January 31, 2011.
PUBLIC COMMENT Chairman Todd opened public comment at 6:31pm. APPROVAL OF MINUITES FOR December 16, 2010 Chairman Todd asked for comments and/or changes to the minutes as submitted. Commissioner Johnson asked for changes regarding mistakes in the minutes. MOTION: Commissioner Wyeth made a motion to approve the minutes with changes requested. Commissioner Fisher seconded the motion and the motion passed unanimously. OLD BUSINESS There was no old business NEW BUSINESSA) Conditional Use Permit request by the City of Maumelle Parks and Recreation Department (The expansion of Municipal facilities into an Open Space zoning district to accommodate the construction of a skate park). Mr. Narey stated the request was to allow a skate park in an area zoned “Open Space”, and the majority response from the community was in favor of this request. Commissioner Johnson asked if with this addition the parking requirement at Maumelle Community Center would still be in compliance with Maumelle City Code. Mr. Narey stated they exceeded the required parking even after the removal of the 20 spaces that would be used for the skate park. MOTION: Commissioner Fisher made a motion to recommend for approval to City Council a Conditional Use Permit application for City of Maumelle Parks and Recreation Department to allow a skate park. Commissioner Wyeth seconded the motion and the motion passed unanimously. B) A re-plat of lots 6&7 Winnetka Acres to Lot 7R Winnetka Acres to accommodate the construction of a Dollar General store.Mr. Narey stated the proposed re-plat was to facilitate the construction of a Dollar General Store within Maumelle’s extraterritorial jurisdiction. Mr. Narey stated after Staff review only two comments remained, to remove the word “final” from the title of the plat, and to satisfy all Pulaski County Staff Comments. Commissioners Kierre and Fisher recused from the vote Mr. Billy Harrington, asked if development plans had been submitted to the City from the applicant. Mr. Narey stated none had been submitted because the property was located in our extraterritorial jurisdiction. Madam City Attorney Davis stated the City could not enforce building or Zoning codes outside of the City limits. Mr. Billy Herrington, 168 Hibiscus Drive stated he was concerned the applicant would build a metal building and later that property would be annexed into the City limits and Maumelle Codes would not be enforceable at that time. Paxton Singleton, 217 West 2nd Street Little Rock, representative of applicant, stated the applicant only intended to meet the requirements that were currently enforceable.
MOTION: Commissioner Johnson made a motion to approve the re-plat of Lots 6 & 7 Winnetka Acres contingent upon satisfaction of all Staff comments. Commissioner Greene seconded the motion and the motion passed unanimously. C) Proposed Ordinance Amendment Sec. 94.1. Definitions ( Specifically new definitions regarding Automated Teller Machine, Building Footprint, Convenience Kiosk, Ice Vending Machine, Stand Alone Use, Vending Machine). Proposed Ordinance Amendment Sec. 94-307. Certain Stand Alone Uses in Commercial Zones (Specifically certain stand alone uses to become conditional uses in all commercial zones and the applicable requirements). Mr. Narey stated Staff recommended a due pass recommendation to the City Council. Commissioner Johnson requested the word “building” be added before footprint under Section 94-1. Commissioner Fisher asked what the design guidelines were regarding the stand alone structures. Mr. Narey stated Code read it should emulate the overall theme of the development in witch the structure was located. MOTION: Commissioner Johnson made a motion to recommend for approval to City Council proposed Ordinance Amendment to Sec. 94-1 Definitions and Section 94-307 Certain Stand Alone Uses in Commercial Zones. Commissioners Green and Fisher seconded the motion and the motion passed unanimously. D) Proposed Ordinance Amendment Sec. 30-92. Specific Standards and Sec. 30-94. Standards for areas of shallow flooding (AO/AH zones) (Specifically a proposal to raise the freeboard height for residential and non-residential construction).Mr. Narey stated the proposed ordinance pertained to raising the lowest habitable floor in both residential and non-residential construction from “at or above base flood elevation” to “two foot above the base flood elevation”. John Wright, 1 Country Club Circle, Maumelle, stated if a resident had flood insurance amending this ordinance would not help them because their elevation did not change.Mr. Narey stated it would benefit those residents if Maumelle became part of the Community Rating System by lowering their insurance rates. Mr. Wright stated the building industry would like to see 1 foot freeboard amendment, and later consider adopting a 2 foot freeboard. Mr. Wright also asked how this would affect Commercial and Industrial properties with portions of the property in the special flood hazard area. Mr. Narey stated in a residential development it is “the lowest habitable floor” and would be the same for all Commercial and Industrial developments. Commissioner Johnson stated when developing you can remove properties from the special flood hazard area by filling, obtaining a letter of map revision, and approval from FEMA. Gibb Carpenter, 123 Osage Drive, stated the value should be considered from a risk vs. reward on the investment, stand point and if “at or above” is insufficient maybe the City should consider one foot to make it less expensive during the construction phase. MOTION: Commissioner Johnson made a motion to recommend to City Council for approval the proposed Amendment to Section 30-92, Specific Standards, and Section 30-94, Standards for areas of shallow flooding (AO/AH zones) (Specifically a proposal to raise the freeboard height for residential and non-residential construction).Commissioner Green seconded the motion and the motion passed with a 4 to 3 vote. Commissioners Todd, Kierre, and Fisher opposed. MOTION: Commissioner Wyeth made a motion to close public hearing. Commissioner Kierre seconded the motion and the motion passed unanimously. PUBLIC HEARING WAS CLOSED AT 7:16 pm. LIASON REPORT December 20 – Chairman Todd stated there was the third reading and adoption of Ordinances 761, 762 and 763. January 3 – Commissioner Kierre stated there were no items pertaining to the Planning Commission. January 18 – Commissioner Greene stated there was Resolution 211 regarding Maumelle water rates. MOTION: Commissioner Johnson made a motion to adjourn the meeting.Commissioner Fisher seconded the motion and the motion passed unanimously. The meeting was adjourned at 7:20 p.m.
